Heard learned counsel for the applicant and the learned A.G.A.
This bail application has been filed on behalf of the applicant involved under Section 498-A, 302 I.P.C., Police Station Karma, District Sonbhadra arising out of case crime No. 76 of 2018.
Learned counsel for the applicant submits that applicant has been falsely implicated in the present case; there is no other evidence against the applicant; applicant is innocent and languishing in jail since 29.5.2018.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that applicant is the husband of the deceased; allegation is against the applicant of beating his wife, subsequently, she succumbed to her injuries; direct role of assault has been assigned to applicant; cause of death is strangulation in the postmortem report.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
