JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 23425 of 1995 Petitioner :- Ravindra Nath Tiwari Respondent :- R.M., Union Bank Of India, Azamgarh & Others Counsel for Petitioner :- Govind Krishna Counsel for Respondent :- S.C.,V.R. Agarwal
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“(i) Issue a writ, rule, order or direction in thenature of certiorari quashing the order dated 2.1.1984 (contained in Annexure '1') passed by respondent no. 2; order dated 28.7.84 (contained in Annexure'2') passed byappellate authority, and the order dated 24.5.1995 (contained in Annexure '10') passed by respondent no. 3.
(ii) Issue a writ, rule, order or direction in the nature of mandamus directing the respondent not to give effect to the aforesaid orders i.e. dated 2.1.1984, 28.7.1984 and 24.5.1995 and direct the respondent to reinstate the petitioner on his post.
(iii) Issue a writ, rule, order or direction in the nature of mandamus directing the respondents to accord all the service benefits admissible to the said post to the petitioner.“
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 26.4.2018 sailesh
