This application under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Code') has been filed on behalf of the applicant with a prayer to direct the court below (A.C.J.M., Court No. 1, Gorakhpur) to decide Criminal Complaint Case No. 1784 of 2016 (Ravindra Kumar Maurya v. Nanhey Maurya), under Sections 406, 420, 504, 506 of I.P.C., Police Station - Khorabar, District - Gorakhpur.
Learned counsel for the applicant contended that recording of statement of witnesses under Section 202 of the Code was concluded on 29.01.2018. After that, several dates have been fixed by the Magistrate concerned. But no order under Section 203/204 of the Code has been passed.
In view of above, the court below/Magistrate concerned is directed to pass orders under Section 203/204 of the Code expeditiously, strictly in accordance with law, preferably within 60 days from the date of receipt of certified copy of order of this Court.
With the aforesaid direction, the instant application stands disposed of.
