Father of petitioner was the clerk in Shri Ram Rekha Singh Inter College, Uruwa Bazar, Gorakhpur, a recognised and aided Intermediate College. He died in harness on 31.5.2000. Widow of the deceased made an application for grant of compassionate appointment after expiry of five years from the date of death. This application has been forwarded by the Director of Education to the State Government on 16.1.2012. Grievance is that upon such application, no decision has been taken by the State Government for relaxing the limitation of five years in making of application. Such claim is stated to have remained pending with the State Government since 16.1.2012.
Learned Standing Counsel submits that the claim of the petitioner shall be examined, in accordance with law.
In view of above, without commenting upon the merits of the case, the writ petition is disposed of with a direction upon the respondent No. 1 to examine the recommendation of the Director of Education, contained in the letter dated 16.1.2012 within a period of 4 months from the date of production of certified copy of this order.
It is clarified that this Court has not examined petitioner's entitlement on merits, and all issues are left open to be considered by the authority concerned, at the first instance.
