Heard learned counsel for the petitioner and learned A.G.A. for the State through Video Conferencing.
By means of this petition, petitioner seeks issuance of a writ in the nature of certiorari quahsing First Information Report bearing Case Crime No.139 of 2021, under Sections 506, 507, 386 I.P.C. & Section 67(a) I.T. Act, 2008, Police Station Thakurganj, District Lucknow.
From a bare perusal of the imupugned F.I.R, it can not be said at this stage that no cognizable offence is made out against the petitioner. Therefore, we are not inclined to entertain this petition. It is accordingly dismissed, however, without prejudice to the rights of the petitioner to avail other remedies under Sections 438/ 439 Cr.P.C. as the case may be, as per law.
