Heard Sri Pankaj Kumar Govil, learned Counsel for the petitioner.
The petitioner seeks remedy against the private bank. He is unable to show from the petition that the private bank is in any way State or any other authority within the meaning of Article 12 of the Constitution of India.
The petition on the face of it is not maintainable as against the order dated 01.02.2019 passed by the respondent no.2, the petitioner has an alternative statutory remedy of filing an appeal under Section 17 of the The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 Act.
It is open to the petitioner to take recourse to the remedy as provided under the Act.
This Writ Petition is dismissed as above. No costs.
