Case called out in the revised list. None is present on behalf of petitioner. Sri Pankaj Srivastava, learned A.G.A. for the State is present.
On 30.10.2018 following order was passed :-
"From perusal of the prayer made in the F.I.R. it transpires that this writ petition was filed against the order passed in appeal, therefore, this writ petition is not cognizable by division bench and it is cognizable by single Judge.
Office is directed to examine the matter and place it before the appropriate Bench, if possible, on 02.11.2018 as fresh."
On 17.11.2018 following order was passed :- "Put up as fresh on 19.11.2018 before the appropriate Court. Assignment, if any, stands discharged."
On the last date i.e. 20.11.2018 following order was passed :-
"List has been revised. No one appears to press this petition. List after two weeks before the appropriate Court."
It appears from the record that the matter has become infructuous by efflux of time.
Accordingly, the petition is dismissed as infructuous. Interim order, if any, stands vacated.
However, it will be open for the parties to move appropriate application within six weeks' from today, if the matter survives.
