Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Vikas Budhwar learned counsel for the respondent-corporation.
By means of this writ petition, the petitioner has come to this court against the imposition of penalty of Rs.10,000/-. The said penalty has been imposed by Hindustan Petroleum Corporation upon the petitioner who runs a retail outlet of the said corporation. The grounds for imposition of penalty is that upon inspection it was found that the toilet in the outlet has neither water and nor electricity.
Leaned counsel for the petitioner submits that said penalty could not have been imposed without issuing a warning letter.
From the order impugned it appears that the petitioner was earlier given a notice to which he responded and accepted the irregularities. Therefore the penalty has been imposed.
Considering the facts and circumstances of the case and the admission of the petitioner that there was actually no water or electricity in the toilet in the outlet which is in violation of the market discipline guidelines of the corporation. As such we are not inclined to interfere with the order impugned.
The writ petition has no merit. It is, accordingly, dismissed.
