This petition for writ is preferred to have an appropriate writ, order or direction to ensure compliance of the provisions of Special Area Development Authority Act, 1986.
In the petition for writ no details have been given with regard to the area where such violation of the act aforesaid has taken place. However, from perusal of the representation submitted to the District Magistrate, Kushinagar, copy whereof is available on record as annexure 1.
It reveals that the cause of the petitioner pertains to some green belt said to be encroached by certain persons. In absence of adequate details, it could not be appropriate for us to interfere in the matter.
The petition for writ hence, is disposed of by keeping the petitioner at liberty to agitate his cause by way of submitting a detailed representation with all necessary particulars to the District to the District Magistrate, Kushinagar. If any such representation is submitted by the petitioner within a period of four weeks from today along with a certified copy of this order, the District Magistrate, Kushinagar shall consider and decide the same in accordance with law expeditiously as far as possible within a period of three months from the date of receipt of such representation.
