Learned advocate for the petitioner submits that the courts below have erred while passing the impugned orders by hearing the accused, which is not permissible when the complaint is dismissed under Section 203 or if process is issued under Section 204 of the Code of Criminal Procedure, 1973.

In view of the above, issue notice returnable on 30th January, 2012.

Direct service is permitted.
