JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
The present application has been preferred by the applicant -convict for temporary bail on the ground that he wants to make preparation for the exam of M.A. Part-I.
The study can be undertaken even if the convict is in jail and therefore, on such ground for preparation of examination, the discretion cannot be exercised. However, for appearing in the examination, the convict may apply well in advance and the matter may be considered in accordance with law.
Subject to the aforesaid observations, the present application is not granted. Rule discharged.
