Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant convict has prayed that he be enlarged on temporary bail to appear in the M.A. Examination.
Learned advocate Mr.Goswami has placed on record the examination schedule published by Gujarat University and pointed out that the exams are starting from 3rd May, 2012.
From jail remarks, we find that on earlier occasion, whenever the applicant-convict was enlarged on temporary bail or on furlough leave, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that the applicant shall be enlarged on temporary bail from 30th April, 2012 to 11th May, 2012 on personal bond of Rs.5,000/- with one surety of the like amount and with the further direction that he shall surrender on 12th May, 2012 to the jail authority.
Application is allowed. Rule made absolute. Direct service today is permitted.
