Gajendra, Advocate) This RSA is filed under Section 100 of CPC., against the judgment and decree dated 19.12.2015 passed in R.A.No. 473/2014 on the file of the 2nd Additional District Judge Mysore, dismissing the appeal and confirming the order dated 26.09.2013 passed in FDP No.5/2011 on the file of the Prl. Judge, Court of Small Causes, Mysuru, allowing the petition filed under Order 20 Rule 18 read with Section 54 of CPC.
This appeal coming on for reporting settlement, this day, the court made the following:
ORDERS ON COMPROMISE PETITION The appellant and respondent are present with their advocates. They present a compromise petition under Order 23 Rule 3 of CPC. The appellant and the respondent have put their signatures on the compromise petition and their advocates have also affixed their signatures. The contentions of the compromise petition are read over and explained to the parties in Kannada language. They submit that they have voluntarily entered into this compromise without any kind of force or influence by anybody else. They also submit that they are aware of the terms of the compromise petition. The respondent reports receipt of Rs.12,50,000/- as stated in clause 3(c) of the compromise petition. The terms of the compromise are lawful and therefore compromise is accepted. Since the shares allotted to the appellant and respondent are described with boundaries, this compromise amounts to final decree.
Registry is directed to draw final decree in terms of the compromise petition.
