THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Petitioner herein is seeking a direction to respondents 3 and 4 to consider and dispose of the application filed by his mother seeking regularization of unauthorized occupation of land bearing Sy.No.26 situated at Kengalkempohalli village, Sompura Hobli, Nelamangala Taluk, Bengaluru Rural District, measuring to an extent of 30 guntas vide representations dated 21.6.2008, 14.9.2010, 20.9.2010 and 26.5.2012 at Annexures-E1 to E4 and representations dated 1.8.2014 and 22.11.2016 vide Annexures F1 and F2. The petitioner would state that the application filed by him is in the register maintained by the 3rd respondent – Tahsildar, Nelamangala, with reference to the applications received for regularization of unauthorized cultivation.
2. Heard the learned counsel for the petitioner as well as the learned Additional Government Advocate. Perused the applications filed by the petitioner. They would indicate that the petitioner has made said applications between 2008 and 2016 seeking regularization, however, till to-day no order is passed on said applications.
3. In that view of the matter, this writ petition is disposed of with a direction to respondent Nos.3 and 4 to take up the applications filed by the petitioner seeking regularization of unauthorized cultivation and dispose of the same in accordance with law provided, the said applications are in order and they are filed within the prescribed time. The said exercise shall be completed within 90 days from the date of constitution of fresh Committee for Regularization of Unauthorized cultivation of lands by the Government for the area in which petitioner is seeking regularization.
Learned Additional Government advocate is permitted to file memo of appearance within two weeks from today.
