JUDGMENT / ORDER

Petitioner is the second accused in Crime No.788 of 2014 of the Vadanappilly Police Station for the offences punishable under Sections 341, 323, 326 r/w Section 34 of the Indian Penal Code, apprehends arrest and has filed this application.
2. Application is opposed by the learned Public Prosecutor. It is submitted that on the relevant day the petitioner and others attacked the de facto complainant with some deadly weapon. Accused 1, 3 and 4 were granted relief by the learned Sessions Judge, Thrissur in view of the nature of allegations made against them. Petitioner assaulted the de facto complainant with deadly weapon which is yet to be identified and recovered. There is fracture of the skull of the de facto complainant.
3. I have heard the learned counsel for the petitioner also.
4. Having regard to the circumstances above stated, request for pre-arrested bail cannot be allowed as that would

2 affect the investigation of the case.
It is directed that in case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of with the above direction.
