Heard learned counsel for the applicant and learned AGA for the State-respondents.
The present bail application has been filed for enlarging the applicant on bail in Case Crime No. 821 of 2015, under Sections 498A, 304B, 302, 201 I.P.C. and 3/4 D.P. Act, Police Station Dhanghata, District Sant Kabir Nagar.
It is contended by learned counsel for the applicant that applicant was out of station, therefore, he was not aware that under what circumstances, her wife was killed at his parental house. It is next contended that he was not present at the time of incident, therefore, he is not responsible for the death of the deceased. It is next contended that the applicant has no criminal history except the present case and he is in jail since 25.8.2015.
Per contra, learned A.G.A. has vehemently opposed the bail application and stated that the deceased had died at the house of the applicant. Therefore, no case is made out for granting bail to the applicant.
Considering the facts and circumstances of the case, the gravity of the offence, the nature of accusations and severity of punishment in case of conviction, there does not appear any good ground to release the applicant on bail.
At this juncture, learned counsel for the applicant prayed that the trial is proceedings at snail's speed, hence the trial court be directed to conclude it within some time bound period.
Keeping in view that the applicant is in jail since 25.8.2015, the trial court is directed to make all possible efforts to conclude the trial expeditiously, if possible, within a period of nine months from the date of production of certified copy of this order.
With the aforesaid observations, the bail application is rejected. Order Date :- 26.10.2018 Arvind
