Represented by the State Public Prosecutor, High Court of Karnataka, Bengaluru – 560 001. …Respondent (By Sri Chetan Desai, HCGP ) This Criminal Petition is filed under Section 439 of Cr.P.C, praying to enlarge the petitioners on bail in Cr.No.216/2016 (S.C. No.15/2017) of Tavarekere Police Station, Ramanagara District for the offence P/U/S 143, 147, 148, 448, 427, 307, 302, 114, R/w 149 of IPC.
This petition coming on for Orders this day, the Court made the following:-
ORDER The petitioners (accused Nos.2, 4, 7 and 8) along with co-accused are charge sheeted in respect of the offences punishable under Sections 143, 147, 148, 448, 427, 307, 302, read with 149 of IPC 2. The allegation is, in pursuance of his previous enmity, the accused No.1 along with co-accused barged into the house of the complainant with lethal weapons and assaulted one Danush and also assaulted the other inmates of the house. Similarly placed co-accused are enlarged on bail by the order of this Court. Investigation having been complete, there is no impediment to allow this petition Accordingly, the petition is allowed. Petitioners are enlarged on bail in Crime No.216/2016 of respondent- police, subject to the following conditions:
(i) They shall execute a self bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with one surety for the likesum to the satisfaction of the concerned court.
(ii) They shall attend the court regularly on all hearing dates.
(iii) They shall not threaten or prevail upon the prosecution witnesses.
