Prayer:- This Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the records and set aside the order made by the Learned Additional District Judge, Fast Track Court No.4, Ponneri in C.R.P.No.12 of 2008 dated 23.12.2010 by confirming the order in M.C.No.8 of 2003 passed by the Judicial Magistrate No.I, Ponneri, on 05.09.2008.
For Petitioners : M/s.B.Gopinath For Respondent : M/s.N.R.Anantharama Krishnan ORDER This petition has been filed to call for the records and set aside the order made by the Learned Additional District Judge, Fast Track Court No.4, Ponneri in C.R.P.No.12 of 2008 dated 23.12.2010 by confirming the order in M.C.No.8 of 2003 passed by the Judicial Magistrate No.I, Ponneri, on 05.09.2008.
2. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondent.
3. The petitioner is undertakes to pay the entire arrears of amount to the first respondent/wife, since the second respondent, who is the daughter of the petitioner, is married with one Janakiraman and now, she has been living with her husband, this petition may be dismissed as against the second respondent.
4. Considering the submission made by the learned counsel appearing for the petitioner, this Court passed the following order:
(i) The petitioner is directed to pay the entire arrears amount to the first respondent within a period of eight weeks from the date of receipt of a copy of this order.
(ii) The Petitioner is directed to pay the monthly maintenance amount to the first respondent without any default.
(iii) In respect of order passed against the 2nd respondent, this petition is allowed and the order of both Courts are hereby set aside in respect of 2nd respondent alone.
Accordingly this criminal original petition is closed.
5. For reporting compliance, post the matter after eight (8) weeks. Consequently, connected miscellaneous petitions are closed.
