Heard learned counsel for the applicant and Shri K.R. Singh, learned Addl. Chief Standing Counsel.
The petitioner is before this Court for initiating contempt proceedings against the opposite party for wilful disobedience of the order dated 02.11.2018 passed in Writ Petition No.23287 of 2018 (Ravi Vakasit v. State of U.P. & Ors.).
On the matter being taken up today, learned Addl. Chief Standing Counsel has produced the order dated 29.4.2019 passed by the Director of Higher Education, U.P. Prayagraj and on the basis of the same it is contended that decision has been taken regarding the grievance of the petitioner for payment of retiral benefits and necessary formalities are under way and as such the writ Court order in question has substantially been complied with.
In view of above, present contempt application stands disposed of directing the opposite party to ensure effective compliance of the order dated 29.4.2019 passed by her and also ensure that entire retiral dues be paid to the applicant within six weeks from the date of production of certified copy of this order. Notices, if any, stand discharged. The applicant would be at liberty to move a fresh application, if the order is not complied with by the opposite party within the stipulated time as aforementioned.
