JUDGMENT / ORDER

Court No. - 34 Case :- FIRST APPEAL No. - 901 of 2019 Appellant :- Ravi Varma Respondent :- Jyoti Counsel for Appellant :- Rajesh Kumar Dubey Hon'ble Sudhir Agarwal,J. Hon'ble Rajeev Misra,J.
1. Heard Sri Rajesh Kumar Dubey, learned counsel for appellant.
2. This appeal under Section 19 of Family Courts Act, 1984 (hereinafter referred to as 'Act 1984') has arisen from judgment and order dated 29.11.2019, passed by Indu Dwivedi, Principal Judge, Family Court, Jhansi on an application under Section 24 of Hindu Marriage Act, 1955 (hereinafter referred to as 'Act 1955') filed by respondent-wife, whereby Court below has awarded interim maintenance at the rate of Rs.2,000/- per month to respondent-wife, Rs.200/- towards conveyance and other expenses for every date attended by respondent-wife before Court below and Rs.3000/- as litigation expenses.
3. Learned counsel for appellant contended that appellant is a labour and has no source of income and he is earning Rs.4000/- per month from labouring, therefore, interim maintenance awarded by Court below is too excessive and prayed that same be reduced. However, we find that Rs.2000/- per month has been awarded as interim maintenance to respondent-wife and said amount cannot be said to be excessive, unjust or arbitrary so as to warrant interference by this Court. No other point has been raised by learned counsel for appellant.
4. Appeal lacks merit and is, accordingly, dismissed at the stage of hearing under Order 41 Rule 21 C.P.C.
Order Date :- 20.12.2019/Prajapati
