Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This is second bail application. The first bail application was rejected on 20.08.2018 by this Court in Criminal Misc. Bail Application No.48109 of 2017.
It is urged by learned counsel for the applicant that applicant is innocent and he is in jail since 24.05.2017; the forensic lab report does not support that the weapon used for causing injury was the weapon recovered from the applicant; applicant is entitled to be released on bail.
Learned A.G.A. has opposed the bail application of the applicant and submits that the witnesses of fact have supported the prosecution case. The applicant is the husband of the deceased and caused injury.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find no good ground for grant of bail to the applicant, Ravi Rai, involved in Case Crime No.263 of 2017, under Sections 498-A, 304-B I.P.C. and Section 3/4 D.P. Act, P.S. Nabawad, District Jhansi.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously, without granting unnecessary adjournment, on day to day basis, from the date of production of a certified copy of this order, if there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
