Heard Shri R.R. Mishra, learned counsel for the petitioner; Shri Rajesh Srivastava, learned Standing Counsel for the State respondents and Shri R.C. Upadhyay, learned counsel for the Gaon Sabha.
With the consent of learned counsel for the parties, the writ petition is being decided without calling for counter affidavit.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioner is before this Court for a direction to the second respondent to decide Case No.104/T-201915060600011 (Report vs. Faujdar and others) under Section 38 of U.P. Revenue Code within stipulated period.
Considering the facts and circumstances of the case and without entering into the merits of the issue, the writ petition is disposed of asking the second respondent to consider and decide the aforesaid case in accordance with law expeditiously and preferably within six weeks from the date of production of certified copy of this order but certainly after giving opportunity to all parties concerned. It is made clear that no unnecessarily adjournment shall be granted in the case and all endeavour should be made to decide the case expeditiously, subject to cooperation of parties as well as convenience/roster of the Court.
