Heard learned Counsel for the applicant, learned A.G.A. and perused the record.
Learned counsel for the applicant submits that the F.I.R. of the alleged incident has been lodged against eight person including applicant making general allegation of Mar Peet with deceased and injured persons. No specific role has been assigned to the applicant. There is cross version of the alleged incident. Two person from the side of the applicant have also sustained injuries. The F.I.R. from both sides have also been lodged. It has further been submitted that no incriminating article has been recovered from the possession of the applicant or on his pointing out. The co-accused Ram Pratap Singh and Lallan Singh having identical role have already been granted bail by this Court vide orders dated 04.11.2015 and 17.12.2015 respectively, therefore, the applicant is also entitled for bail on the ground of parity. The applicant is in jail since 03.02.2015.
Per contra, learned A.G.A. opposed the prayer for bail but could not dispute the fact that co-accused having identical role have already been released on bail.
Having given my thoughtful consideration to the submission of the learned counsel for the parties, without expressing any opinion on the merits of the case, I am of the opinion that it is a fit case for bail.
Let the applicant Ravi Mohan involved in Case Crime No.245 of 2015, Under Sections 147, 148, 323, 325, 308, 506, 304 I.P.C., Police Station Maharaj Ganj, District Faizabad, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned with the following conditions:
