Heard Sri Jai Narain, learned counsel for the applicant, learned AGA for the State and perused the material brought on record.
The submission of learned counsel for the applicant is that this is the forth Bail Application for grant of bail. The First and Third Bail Application of the applicant had been rejected in default. The Second Bail Application of applicant had been rejected on merit by this Court on 06.03.2017. Further submission is that applicant who is in jail since 21.04.2015 has no other criminal history and there is also no possibility of his either fleeing away from the judicial process or tampering with the witnesses.
Learned A.G.A. has vehemently opposed the prayer.
Having heard the submissions of learned counsel of both sides, considering the facts and circumstances of the case and taking a note of the fact that prompt FIR of the incident has been lodged naming applicant therein and it is supported with medical evidence also, I do not find it to be a case of bail.
Accordingly, application for grant of bail of the applicant Ravi Kumar who is involved in Case Crime No. 55 of 2015, under Sections 363, 366, 376 IPC and 4 POCSO Act, Police Station- Nidhauli Kalan, District-Etah, is rejected.
