The sole relief claimed in the instant petition is for issuance of a direction to the Prescribed Authority, before whom P.A. Case No. 8/2013 is pending, to decide the same, within a specified time.
The aforesaid case is pending at the behest of the petitioners. They had filed an application under Section 21(1)(a) of U.P. Act No. 13 of 1972. The defendant is duly contesting the proceedings. A perusal of the order sheet reveals that although regular dates are being fixed in the case, but for one reason or the other, the proceedings have not concluded so far.
Having regard to the facts of the case and the legislative intent contained in Rule 15(3) of the Rules framed under the Act, the Prescribed Authority is directed to make all endeavour to decide the release application expeditiously, without granting unnecessary adjournments, preferably within a period of four months from the date of receipt of certified copy of this order, provided there is no legal impediment.
The writ petition stands disposed of as above.
