THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Heard the learned counsel appearing for the petitioner/accused and the learned High Court Government Pleader appearing for the respondent-State.
2. The petitioner is in judicial custody in Cr.No.172/2017 registered by the respondent police for the offences under Sections 109, 120-B, 419, 420, 467, 468, 471 r/w section 34 of IPC and section 42 of the Aadhar Card Act, 2016. He was not named in the FIR. During the course of investigation he is arraigned as A-6.
3. The allegation is, the petitioner is involved in fraudulent enrolment of Aadhar numbers by issuing fabricated attestation of proofs of identities and addresses.
4. Learned counsel for the petitioner submits that the petitioner is a Group ‘D’ employee in the hospital. Except carrying out the orders given by his superiors, he has no hands in the alleged offence. A-1/Sr. Specialist of the hospital is enlarged on bail by the order of this Court in Crl.P.No.5263/2017.
5. The petitioner being the employee of the State Government, there is no reason to suspect that he will abscond and cause hurdle to the investigation or for further trial.
Hence, the petition is allowed. Petitioner is enlarged on bail in Cr.No.172/2017 registered by the respondent- police on the following conditions:
(i) He shall execute a self bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the concerned Court.
(ii) He shall co-operate with the Investigating Officer during further course of investigation.
