Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and perused the record.
On 26.8.2021 following order was passed:-
"Learned Standing Counsel to obtain instructions regarding status of the police report drawn up in pursuance of the application for grant of arms licence made by the petitioner on 18.12.2019. The delay in creation of the police report shall also be explained.
Put up this matter on 22.09.2021 in the list of fresh cases."
Learned Standing Counsel states that he has written letter, however, till date he has not received any instruction in the present case.
Learned counsel for the petitioner submits that the petition may be decided by directing the respondents to take appropriate decision on the application filed by the petitioner.
In such view of the matter, no fruitful purpose would be served by keeping the petition pending or calling for any counter affidavit.
Present petition has been filed for directing to the respondent no. 2 to decide the application dated 18.12.2019 within the stipulated time as Hon'ble Court may deem fit and proper, otherwise applicant/ petitioner will suffer irreparable loss and injury.
The case of the petitioner is that he had applied for grant of an arms licence on 18.12.2019 but no order has been passed and the said application is still pending with the District Magistrate/ Licensing Authority, Prayagraj.
Considering the facts and circumstances of this case, this writ petition is finally disposed of with the direction that the application of the petitioner shall be considered and decided by the respondent no. 2-District Magistrate/ Licensing Authority, Prayagraj, in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of production of self- attested copy of this order, which may be verified from the official website of this Court.
With the aforesaid observation/ direction, present petition stands disposed of.
