Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below i.e. Additional Chief Judicial Magistrate, Court No. 9, District Varanasi to decide the Complaint Case No. 1356 of 2015 (now changed as 724/18) (Ravi Kumar Jaiswal Vs. Om Prakash Chaubey), under Section 138 N.I. Act, Police Station Cantt, District Varanasi within shortest/stipulated period of time.
Considering the fact that the trial has remained pending since the year 2015. Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, within a period of six months from the date of production of certified copy of this order, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
