Sri Yogendra Misra and Sri S.N.Yadav have filed their vakalatnama on bhelaf of the informant.
Heard learned counsel for the applicant, learned counsel for the informant and the learned A.G.A appearing for the State and perused the record.
This bail application has been filed on behalf of the applicant involved under Sections 302, 34 I.P.C., P.S. Sirsaganj, District Firozabad arising out of case crime No. 775 of 2017.
As per the prosecution case the brothers of the informant have sold some buffaloes to the applicant; on demanding money some dispute took place between the parties; applicant caused fire arm to the brother of the informant namely Avneesh Kumar who succumbed to his injuries. It is urged by learned counsel for the applicant that there is no intention to kill the deceased; applicant has some dispute with Rajesh Kumar, who sold the buffaloes; applicant is languishing in jail since 13.10.2017.
Learned A.G.A. and learned counsel for the informant have opposed the prayer for bail and submits that specific role of firing has been assigned to the applicant; recovery of fire arm has been made from the applicant; postmortem report corroborates the commission of the offence by the fire arm; it is not in public interest to grant bail at this stage.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
