Crl. Misc. Parole/Short Term Bail Application No.13 of 2019 Heard learned counsel for the appellants and the learned AGA for the State.
This short term bail application has been filed by Ravi Kant Mishra - sole appellant for he be permitted to participate in the marriage ceremony of his daughter namely Sweta Mishra which is scheduled to be performed on 25.06.2019, as being father his presence is required.
Learned AGA for the State submits that he has no objection if the short term bail is granted to appellant.
In the facts and circumstances of the case, the accused-appellant namely Ravi Kant Mishra is permitted to participate in the marriage ceremony of his daughter. For the said purpose he may be taken from jail to the place of marriage in the morning of 20.06.2019 and shall be returned to jail in custody of two police constables by the evening of 01.07.2019. During all this period the two police constables shall accompany the accused - appellant. The expenses for the purposes shall be borne by the accused - appellant himself and the money to be quantified by the Superintendent of concerned Jail shall be deposited in advance with the concerned authority.
In case of non deposit of the money, as indicated above, the accused - appellant shall not be entitled to the benefits of this order.
Short term bail application is disposed of.
Let a copy of the order be issued to the learned counsel for the appellant today itself on payment of usual charges.
The case will be listed on 08.07.2019, on which date learned counsel for the appellant will inform the Court by means of a supplementary affidavit that appellant has surrendered or not, if yes, then surrender certificate in this regard shall also be annexed with the said affidavit.
