Heard learned counsel for the applicant, learned A.G.A. for State and perused the materials available on record.
Accused-applicant, involved in Case Crime No. 275 of 2021, under Sections 409 and 411 IPC, Police Station Barra, District Kanpur Nagar, applied for bail.
Learned counsel for the applicant submits that accused-applicant is innocent and has been falsely implicated in the present case. He has committed no offence and prosecution story is false and fake. It is further submitted that there was a dispute in respect of payment of salary between applicant and Officer of Secured Value India Limited, due to which he was falsely implicated in the present case. He neither committed any offence of criminal breach of trust nor any embezzlement. Nothing has been recovered from his possession. Recovery is false and fake.There is no criminal history to his credit and applicant is in Jail since 08.04.2021. There is no possibility of applicant's fleeing away from the judicial process or tampering with the witnesses. In case, the applicant is enlarged on bail, he shall not misuse the liberty of bail and shall cooperate the trial. Due to heavy pendency of cases, there is not possibility of early disposal of trial. If applicant is released on bail, he will make a good defence.
Learned AGA opposed the prayer for bail and submitted that accused-applicant was an employee of Secured Value India Limited who was authorized to keep money in different ATMs after taking the same from Bank. On the verification of ATM being made by the Bank on 24.3.2021, there was a deficiency of Rs. 11,000,00/-, for which accused is responsible. As per FIR, applicant was responsible to keep the money in ATM. During investigation, Rs. 19500/- has been recovered from him which is said to be embezzled amount.
Considering the entire facts and circumstances of the case, rival contentions of learned counsel for parties, offence alleged against the accused- applicant and deficiency of money in ATM and evidence collected by Investigating Officer during investigation, I do not see any good ground to release the accused on bail. It is accordingly rejected.
