Heard learned counsel for the petitioner, learned standing counsel for State- respondents and Sri Satish Chandra Yadav, learned counsel for respondent nos. 3 and 4.
Present petition has been filed with following relief;
"3) Issue a writ, order or direction in the nature of mandamus, directing the respondents to appoint the petitioner on the post of Assistant Teacher in Primary School under the provisions of Die in Harness Law and Rules."
Learned counsel for the petitioner submits that for redressal of grievance, he has moved application dated 13.12.2019 (Annexure 9 to the writ petition) before respondent no. 4, but till date, the same has not been decided. He next submitted that a suitable direction may be issued to respondent no. 4 to consider the application of the petitioner dated 13.12.2019 and decide the same within stipulated time Learned Standing Counsel as well as learned counsel for respondent nos. 3 and 4 has no objection.
Under such facts and circumstances, this petition is disposed of with direction to respondent no. 4 to consider the application of the petitioner dated 13.12.2019 and decide the same strictly in accordance with law maximum within a period of six weeks from the date of production of computer generated copy of the order. Petitioner is also given liberty to file fresh representation along with computer generated copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 4 to decide the representation of the petitioner after considering the Act, Rules, Government Orders, Judicial pronouncement made by the Court as well as facts of the case.
