THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 23643 of 2014 ORDER: (Per the Hon’ble Sri Justice Sanjay Kumar) This petition is filed for a writ of Habeas Corpus to produce the alleged wife of the petitioner from the alleged illegal custody of her family members who are arrayed as respondent Nos.4 to 6.
In effect, the petitioner is seeking restitution of his conjugal rights. We are of the opinion that a writ of Habeas Corpus would not lie on the given facts and the remedy of the petitioner is to approach the appropriate forum for seeking redressal of his grievance. Further, if the petitioner alleges commission of any offence, it is for him to take appropriate action as per the provisions of the criminal law.
Subject to the above observations, the writ petition is dismissed. No order as to costs.
