The petitioner was given permission to construct a residential building. The petitioner approached the Geologist for issuance of 'P forms'. This was considered pursuant to the judgment of this Court as per Ext.P5. It is stated in Ext.P5 that the petitioner has to use ordinary earth in the site itself and he shall not remove the sand outside to the site. The Geologist has no right to insist that the petitioner should use the ordinary earth in the site itself.
Therefore, Ext.P5 is set aside to the above extent restricting the petitioner from removing ordinary earth outside to the site. The Geologist shall issue necessary 'P forms' to the petitioner within ten days from the date of receipt of a copy of this judgment without insisting for work order.
The writ petition is disposed of as above.
