Satta, learned advocate for the petitioners, and Ms.Niyati K. Shah, learned advocate appearing for respondent No.4­Municipality, and in fact the matter was kept for orders on 01.10.2012. However, at the request of the court to explore possibility of providing some alternative accommodation to the petitioners, Ms.Shah, learned advocate appearing for respondent No.4­Municipality, was kind enough to explore the same and on instructions provided application form for I.H.H.D.P Scheme, where all the petitioners can be accommodated, of course on completion of the scheme. A copy of the said form was also provided to the learned advocate for the petitioners.
Today, the learned advocate for the petitioners submits that the petitioners do not agree with the aforesaid proposal and in fact Shri Baldev Amarsinhbhai Bijalbhai Taviya, son of petitioner No.6 SCA/17678/2011 2/2 ORDER herein, is present in person along with other affected persons and requested for time to produce some proof. In fact the persons present desire to have 15 days time and also made an endevour to tender some written submissions in Gujarati. However, as copy of the said submissions was not given to the learned advocate appearing for respondents, the same was not permitted to be placed on record of the present petition. However, considering the fact that the case of the petitioners that they stay on the land in question since about 40­45 years, as averred in the petition, in the interest of justice, as a last chance, the matter is kept on 08.10.2012.
Gist of this order is explained to Shri Baldev Amarsinhbhai Bijalbhai Taviya, son of petitioner No.6 herein, who is present in person in Gujarati.
