Heard Ms. Annapurna Devi, learned counsel for the applicant and learned A.G.A for the State.
This application under Section 482 Cr.P.C. has been filed challenging the orders dated 4th July, 2018 and dated 23rd May, 2017 passed by the Additional Chief Judicial Magistrate-V, Ghaziabad in Complaint Case No. 4788 of 2008 (Deepa vs. Ratnesh), under Sections 18,20 and 22 of the Protection of Women from Domestic Violence Act, 2005 (hereinafter referred to as the "Act, 2005") ,Police Station Modinagar, District Ghaziabad.
Admittedly against the orders impugned in thepresnet criminal application, the applicant has got statutory alternative remedy by way of appeal under Section 29 of the Act, 2005.
In view of the availability of statutory alternative remedy, there is no occasion before this Court to entertain the present criminal application.
The present application is, accordingly, dismissed on the ground of statutory alternative remedy.
