Heard the learned counsel for the applicant and learned AGA.
It is contended by the learned counsel for the applicant that the dispute is between husband and wife. I consider it approprate to send the matter to Mediation center.
Let the record of this case be placed before the Registrar/Incharge of 'Allahabad High Court Mediation and Conciliation Centre'. The Registrar/Incharge of the Mediation Center will issue notices to both the parties fixing a date for their personal appearances at the centre before the mediator nominated by the Organizing Secretary of the Mediation Centre.
The Mediation Centre is allowed three month's time to find a possible solution of disputes between the parties.
The case will be listed before the appropriate Bench in the 1st week of September, 2010 along with the report of conciliator. The applicant is directed to deposit Rs. 10,000/- with Mediation Center within a period of three weeks out of which Rs. 5000/- shall be handed over to the wife respondent no.2 Smt.Deepa.
Meanwhile, further proceedings of Case No. 44 88 of 2008 under Sections 18, 20, 22 of Domestic Violence Prevention Act, I.P.C., P.S. Modinagar District Ghaziabad shall remain stayed.
