Heard Sri Ashish Tripathi, learned counsel for the petitioner, Sri Vikas Srivastava, holding brief of Sri S.K. Yadav, learned counsel for the caveator/respondent no.3 and Sri S.K. Singh, learned AGA for the State and perused the record.
Learned counsel for the caveator/respondent no.3 states that the copy of the present petition which is stated to have been received by Sri S.K. Yadav, learned counsel for the caveator has actually not received by him and the same has been received today on a call made to him.
When query was made from learned counsel for the petitioner then he admitted the said fact and stated that it was the mischievous act of his clerk. He has tendered his unconditional apology on behalf of his clerk who has mentioned the same on the petition. He states that the present petition be dismissed as not pressed with liberty to file fresh petition.
The present writ petition is, accordingly, dismissed as not pressed with liberty to file fresh petition after serving the copy of the petition to learned counsel for the caveator.
