Learned Additional Public Prosecutor Mr. R.C.Kodekar waives service of notice of Rule on behalf of the respondent-State.
2. The applicant seeks relaxation of conditions imposed by this Court while suspending sentence and granting him bail to the effect that he shall confine himself to the territorial limits of State of Gujarat and shall deposit his passport, if any, with the trial court. The relaxation is sought for going to Russia for the period between 01/05/2012 to 31/07/2012 to attend the convocation ceremony of his son, which is scheduled to be held on 22/06/2012. He has annexed necessary papers to support his application.
3. In the facts and circumstances of the case, the application is allowed. The conditions imposed by this Court and sought to be relaxed are relaxed for a period upto 31.07.2012. The trial Court is directed to return the passport of the applicant. Rule made absolute accordingly. Direct Service is permitted.
