ORDER IN CIVIL APPLICATION NO.12389 OF 2012 RULE. Mr. P.C. Chaudhari, learned counsel appearing for the respondent waives service of rule.
We have heard learned counsel Mr. Dipak R. Dave appearing for the appellant and Mr. P.C. Chaudhari, learned counsel appearing for the respondent.
Until further orders of the Court, the effect and operation of the award dated 7.9.2010 passed by the Labour Court, Ahmedabad in Reference (LCA) No.1767 of 1996 qua 50% back wages shall remain stayed, on condition that the applicant shall deposit the amount of 50% back wages before the Registry of this Court within a period of one month from today. Upon deposit of Page 1 of 2 C/LPA/1382/2012 ORDER the said amount by the applicant, the Registry is directed to invest the said amount in the Fixed Deposit Receipt for a period of one year with the Nationalized Bank. The said Fixed Deposit Receipt shall be renewed year to year till the final disposal of the appeal. The amount that may be deposited by the applicant shall be subject to the final decision in this appeal. The applicant is further directed to reinstate the respondent No.1 within a period of one month from today.
With the above observation and direction, this application stands accordingly disposed of. Rule is made absolute to the above extent.
