1. This application has been preferred by the legal heir of the original petitioner, who is already on the record of the petition, with a prayer to permit him to withdraw the petition being Special Civil Application No.6736/2008.
2. Heard Mr.Sanjay Joshi, learned advocate for Mr.P.R.Thakkar, learned advocate for the applicant. It is submitted by Mr.Joshi that after the death of the applicant's father, the applicant does not want to proceed with the petition and wants to withdraw it unconditionally. The same averments are to be found in paragraph-3 of the application.
3. In view of the averments made in the application and the submissions made at the Bar, the following order is passed :
Permission to withdraw Special Civil Application No.6736/2008, is granted. The petition is disposed of, as withdrawn.
The application is disposed of, in the above terms.
