JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE V. M. SAHAI)
1. Rule.
Learned Assistant Government Pleader Mr. N.J.Shah waives service of notice of Rule on behalf of respondent nos.1 and 3. Learned counsel Mr. R.A.Mishra waives service of notice of Rule on behalf of respondent no. 2. These are the application for condonation of delay in filing Letters Patent Appeals. Heard learned counsel Mr. R.D.Dave for the applicants, Learned Assistant Government Pleader Mr. N.J.Shah for respondent nos. 1 and 3 and learned advocate Mr. R.a.Mishra for respondent no.3.
2. Considering the contents of the application, it cannot be said that the delay caused in filing the Appeal has remained totally unexplained. Therefore, we are of the view that the delay caused in filing Letters Patent Appeals deserves to be condoned. Accordingly, the applications are allowed. Delay is condoned. Rule is made absolute.
3. Since other connected matters are listed for final hearing on 6th May, 2011, list these Appeals also alongwith Letters Patent Appeal No. 2051 of 2010 alongwith other connected matters.
