ORDER:
Heard.
2. Petitioner’s application for release was rejected by the Deputy Transport Commissioner & Secretary on the ground that petitioner is not able to produce the original documents relating to the Harvestor and Tractor and the photo copies produced are not legible. The present writ petition is directed against that order.
3. However, I do not see any irregularity in the Deputy Transport Commissioner’s order as petitioner has to produce original or at least authenticated legible copies to enable the Deputy Transport Commissioner to appreciate the petitioner’s application for release of the vehicle.
4. Learned counsel for the petitioner had taken time and submits, on instructions today, that he has got the original documents relating to the Tractor, which he will produce before the Deputy Transport Commissioner and to the extent of Harvestor, he will produce authenticated copies as the originals are stated to have been lost by the petitioner.
5. Hence, the writ petition is disposed of and the impugned order to that extent is set aside by remitting the matter to the Deputy Transport Commissioner. Petitioner shall produce the documents, as noted above, before the said authority, who shall re-examine the matter and pass appropriate fresh order within two weeks from the date of petitioner producing the document and approaching the learned Deputy Transport Commissioner.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
