The Deputy Commissioner & Election Commissioner Sub-Division Shimoga 577 201. … Respondents (By:Mr.B.N.Prakash, Advocate for R1 to R6 Mrs.Prathima Honnapura, AGA for R8) This Writ Petition is filed under Articles 226 & 227 of Constitution of India, praying to quash the notice dated 22.02.2018 issued by the Deputy Commissioner (Election) Shimoga as illegal, arbitrary and in violation of principles of natural justice (Annexure-G) and etc.
This Writ Petition coming on for orders this day, the Court made the following:
ORDER There was no representation for the petitioner when the matter was called out. On 04.06.2018, there was no representation on behalf of the petitioner. Similarly, on 14.08.2018 and 21.08.2018 also there was no representation for the petitioner when the matter was called out. The petitioner is not earnestly and diligently prosecuting the proceedings.
2. Taking note of the absence of diligence in prosecuting the proceedings and noting the absence of petitioner on the said dates, petition is dismissed for non-prosecution.
