Respondents (Respondents 2 and 3 suo motu impleaded vide order dated 26.02.2016 made in Cont.P.No.5 of 2016) Petition filed under Section 11 of Contempt of Courts Act to punish the respondents for wilful disobedience of the order of this Court made in W.P.No.10777 of 2012 dated 17.07.2013.
For Petitioner .. Mr.S.Kumarasamy For Respondents .. Mr.M.Santhanaraman, Addl. Govt. Pleader ORDER The present contempt petition has been filed against the order passed by this Court in W.P.No.10777 of 2012 dated 17.07.2013.
2. On notice issued to the learned Additional Government Pleader appearing for the respondents, instructions have been obtained and today, when the matter is taken up for hearing, he has produced the proceedings of the Chief Conservator of Forests and Director, Arignar Anna Zoological Park, Vandalur, dated 29.07.2017, in and by which, it appears that the direction passed by this Court has been complied with.
3. This Court has also gone through the proceedings and found that there has been compliance of the order passed by this Court. However, the learned counsel for the petitioner has some apprehension as to whether the said proceedings is in full compliance of the orders passed by this Court or not. In case, he has any serious doubts about the full compliance of the direction, it is not for him to pursue the course of contempt petition. It is always open to him to file a separate proceedings as he deems fit for any other relief which he claims to be entitled to. However, the contempt petition cannot be kept pending in view of the present proceedings passed in Proc.No.4217/2012/E2 dated 29.07.2017. In view of the same, the contempt petition is closed.
