JUDGMENT / ORDER

Petitioners are accused Nos.1,2,4 and 5 in Crime No.299 of 2014 of the Kasargode Police Station for the offences punishable under Sections 143, 145, 147, 148, 332, 353 read with Section 149 of the Indian Penal Code and Section 3(1) of PDPP Act, apprehend arrest and have filed the application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that on 16.03.2014 at the relevant time a KSRTC bus hit two motor cyclists, one of whom died and other sustained injuries. Following that, the petitioners and other identifiable persons went to the bus depot, attacked the police officer on duty and damaged three buses causing loss of around `11,500/-.
3. The learned counsel submitted that the allegations against the petitioners are not true. It is submitted that Bail Appl.No. 3989 of 2014 () 2 the 6th accused was arrested and released on bail by the learned magistrate concerned.
4. Having regard to the nature of the allegations made against the petitioners and the investigation required to be done, request for pre-arrest bail cannot be granted since that might affect investigation of the cases. It is directed that in case the petitioners are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
The application is disposed of as above.
