Petitioners are accused in Crime No.98 of 2014 of the Vellamunda Police Station for the offence punishable under Section 55(i) of the Abkari Act for the alleged possession and transportation of 101 bottles of IMFL each containing 500 ml in an autorikshaw, are in custody from 21.03.2014 and seek bail. 2. I have heard the learned counsel for petitioners and the learned Public Prosecutor. Learned Public Prosecutor has submitted that the final report was filed on 25.05.2014.
3. Petitioners are not reported to be involved in any other case from the Vellamunda Police Station.
3. Having regard to the circumstances of the case I am inclined to grant relief but subject to conditions.
Application is allowed as under:
Petitioners are granted bail in Crime No.98 of the Vellamunda Police Station and shall be released, if not required to be detained otherwise on their executing bond for Rs.30,000/- (Rupees thirty thousand only) each with two sureties each for the

like sum each to the satisfaction of the learned jurisdictional and subject to the following conditions:
(a) One of the sureties shall be a close relative of any of the petitioners.
(b) Petitioners shall report to the officer investigating the case on every Saturday between 4.00 and 5.00 p.m until otherwise ordered by the learned magistrate until committal and thereafter by the learned Principal Sessions Judge concerned.
(c) Petitioners shall report to the officer investigating the case if and when required for interrogation.
(d) Petitioners shall not get involved in any offence during the period of this bail.
(e) Petitioners shall not intimidate or influence the witnesses.
(ii) In case petitioners violate any of conditions (b) to (e), it is open to the investigating Officer to move the learned magistrate/learned Principal Sessions Judge as aforesaid for cancellation of the bail as held in P.K.Shaji v. State of Kerala (AIR 2006 SC 100).
