JUDGMENT / ORDER

Accused 1 to 3 and 6 in Crime No.620 of 2014 of the Angamaly Police Station Office for the offences punishable under Sections 143, 307, 324, 452, 109 r/w Section 149 of the Indian Penal Code, Section 27 of the Arms Act, seek bail.
2. Learned Public Prosecutor has opposed the application. It is submitted that on the relevant day and time, violating the order issued by the authority under the KAAPA that accused 1, 2 and 3 shall not enter Ernakulam District, they along with others came to the scene of occurrence which is in Ernakulam District and assaulted the de facto complainant and others with weapons including swords. Accused 1 to 3 are being proceeded against under the KAAPA. The first accused is involved in 8 other cases including Section 302 of the Penal Code while the second accused is involved in 6 other cases. The third accused is involved in 11 cases and the 6th accused is involved in one case.
3. Learned counsel submits that these accused are not involved in the alleged incident. They are falsely implicated in other cases. The first accused is in custody from 05.04.2014

2 while the second accused is in custody from 28.03.2014, third accused is in custody from 21.03.2014 and the 6th accused is in custody from 04.04.2014.
4. True, these accused are in custody since long. But the nature of the incident and other circumstances I have referred above are to be borne in mind. I am inclined to think that request of these accused for bail cannot be allowed.
Application is dismissed.
