Heard learned counsel for the petitioner and perused the record.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(i) Issue an appropriate order or direction in the nature of directing to the Additional Civil Judge (Senior Division) Court No. 3, Ghaziabad for deciding the interim injunction application, which is pending for consideration, since 31.07.2018, filed in Original Suit No. 741 of 2018 (Ratan Yadav and others Vs. Nagar Nigam Ghaziabad & others), within a stipulated period."
It is submitted that the aforesaid interim injunction application has remained pending.
Considering the overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid interim injunction application strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of two months positively from the date of production of copy of this order.
Copy of the order available on the official website of the High Court will be taken to be authentic one.
