The petitioner claims that his patta, granted by the Gram Sabha and approved by the authorities in the year 1989, has been cancelled during chakbandi proceeding under Section 6 of the Consolidation of Holdings Act, 1953 by order dated 30.8.2017.
According to learned Standing Counsel against the said cancellation the petitioner has remedy of filing an application before the Collector as under Section 58 of the U.P. Revenue Code, 2006 it is provided that such dispute can be considered and decided by the Collector.
As such, the petitioner may make an application before the Collector who will consider the claim of the petitioner and pass appropriate orders in accordance with law within a period of two months from the date a certified copy of this order along with an application is presented before the Collector concerned.
For a period of two months no interference will be caused in the land of the petitioner by the authorities.
With the aforesaid observations/directions, the writ petition is disposed of.
